Emanate ("we" or "us") establishes this Privacy Policy ("this Policy") for the handling of personal data of all users (“User(s)“) who use RepliCam (this “Service.” Regardless of the reason, if the name or content of the Service is changed, this Agreement will include the Service after such changes.).
Article 1 (Personal data)
“Personal data" refers to information about a living individual, which can identify a specific individual by name, date of birth, address, phone number, contact information, or other descriptions included in the information, in accordance with the Japanese law (Act on the Protection of Personal Information).
Article 2 (Collection Method of Personal Data)
- We may ask Users to provide personal data such as name, date of birth, address, phone number, email address, bank account number, credit card number, driver's license number, etc., when Users register for the Service.

Article 3 (Purpose of Collecting and Using Personal Data)
The purposes for which we collect and use personal data are as follows:
- To deliver information optimized for individual Users of the Service
- To contribute to the improvement of the quality of the Service through statistical analysis
- To respond to inquiries from Users, including identity verification
- To send information about campaigns and new products conducted by us
- For necessary communications, such as maintenance and important notices
- To allow Users to view, modify, delete, and check the usage status of their registration information
- Any other purposes related to the above purposes
Article 4 (Provision of Personal Data to Third Parties)
- Except as otherwise provided in laws and regulations, we will not provide personal data to third parties without the User's consent. However, this does not apply in the following cases:
- Based on laws and regulations
- When it is necessary to protect human life, body, or property, and obtaining the User's consent is difficult
- When it is particularly necessary for the improvement of public health or the promotion of sound growth of children, and obtaining the User's consent is difficult
- When it is necessary for us to cooperate with a national agency, local public body, or a person entrusted with the execution of prescribed affairs by laws and regulations, and obtaining the User's consent is likely to impede the performance of such affairs

Article 5 (Disclosure of Personal Data)
- When a User requests the disclosure of personal data, we will disclose it to the User without delay. However, if disclosing all or part of it falls under any of the following, we may not disclose it, and if a decision not to disclose is made, we will notify the User promptly. A handling fee of 1,000 yen per case will be charged for the disclosure of personal data.
- When there is a risk of harming the life, body, property, or other rights and interests of the individual or a third party
- When there is a risk of significantly hindering the proper implementation of our business
- When it would violate laws and regulations
- Notwithstanding the provisions of the preceding paragraph, we will not disclose information other than personal data, such as browsing history and characteristic information, in principle.
Article 6 (Suspension of Use, etc., of Personal Data)
If a User requests the suspension or deletion of the use of personal data on the grounds that it is handled beyond the scope of the purpose of use or that it has been acquired by fraudulent means, we will promptly conduct the necessary investigation based on the results and notify the Users of the suspension of use, etc. of the personal data. However, if it is difficult to take measures to suspend use, etc., we will take alternative measures necessary to protect the User's rights and interests.
Article 7 (Request Regarding Minors)
If the User is between 13 (or 16 in certain jurisdictions) and 18, we request that the User provides personal data to us under the consent of the Users’ legal guardian.
Article 8 (Note to Users outside of Japan)
We are based in Japan, and the Service is controlled and operated by us from Japan. Therefore, we are not subject to the laws or jurisdiction of any country or territory other than that of Japan. Your personal data may be stored and processed in any country where we or our partners have facilities, and by using the Service you consent to the transfer of information to countries outside of your country of residence, including Japan and the United States, which may have data protection rules that are different from those of your country. In certain circumstances, courts, law enforcement agencies, regulatory agencies or security authorities in those other countries may be entitled to access your personal data.
Article 9 (Changes to Privacy Policy)
The content of this Policy can be changed without notifying Users. The revised Privacy Policy will be posted on the Service or the website operated by us.
